These Terms of Service (“Terms”) govern access to the Know Thy Pool website, mobile application, Pool Passport pages, and related services (collectively, the “Services”). “Know Thy Pool,” “we,” “us,” and “our” refer to the legal operator of the Services, whose full entity name and address must be added before launch.
1. Acceptance and eligibility
By accessing or using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old and legally able to enter a binding agreement, or use the Services through an authorized business or organization. Additional age and regional requirements may apply.
2. What the Services provide
Know Thy Pool helps users create and maintain records connected to a physical swimming pool, including specifications, water tests, maintenance, equipment, warranties, service, repairs, inspections, safety reports, and ownership transitions. Some features may be identified as beta, planned, or coming soon and may change or never become generally available.
3. Accounts and access
- Provide accurate information and keep it current.
- Protect your login credentials and promptly report suspected unauthorized access.
- Use separate authorized access for household members, employees, contractors, or other participants rather than sharing credentials.
- You are responsible for activity under your account to the extent permitted by law.
We may use reasonable verification steps before allowing a person to claim a pool, control its record, transfer ownership, access nonpublic history, or act for a business.
4. Pool records and user contributions
You retain ownership of content you submit. You grant Know Thy Pool a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and otherwise use that content as reasonably necessary to operate, secure, and improve the Services and maintain the pool’s record.
You represent that you have the right to submit the content, that it is accurate to the best of your knowledge, and that it does not violate law, privacy, confidentiality, intellectual-property, or contractual rights. Clearly identify estimates, opinions, and unverified information. Do not submit sensitive personal information that is unnecessary for the pool record.
5. Owner controls and professional submissions
Owners may invite others, review contributions, approve certain information for display, and control access to fuller history. Professionals, builders, and inspectors may submit records only for work they performed, observed, or are authorized to document. Owner approval does not make a contribution correct, certified, or endorsed by Know Thy Pool.
We may preserve audit information, contributor identity, timestamps, and prior versions where reasonably needed for record integrity, fraud prevention, safety, or dispute resolution.
6. Public Pool Passports
A Pool Passport may make limited information visible to someone who scans or enters its identifier. Do not treat possession of a Pool Passport link or code as proof of ownership or authorization. The public passport is not intended to display a property address, owner name, private contact information, account credentials, or service schedule.
7. Ownership transfers
Pool records are designed to follow the physical pool. A verified ownership transfer may end a prior owner’s access while preserving legitimate historical records. Users must not attempt to claim a pool they do not own or control, interfere with a valid transfer, or remove accurate records solely to obscure the pool’s history.
8. Safety reports and emergencies
Safety reporting is a communication aid, not an emergency service or monitored alarm. Reports may be delayed, incomplete, inaccurate, or unseen. If there is immediate danger, a suspected drowning, unsafe electrical condition, chemical exposure, or another emergency, contact local emergency services and take appropriate action. Do not rely on Know Thy Pool to dispatch responders or make a pool safe.
9. No professional, inspection, or chemical advice
The Services organize records and may provide general guidance. They do not replace a licensed or qualified pool professional, builder, inspector, electrician, engineer, medical professional, manufacturer instructions, local code requirements, or an independent property inspection. Water readings, condition labels, scores, trends, reminders, automated outputs, and AI-assisted features may be incomplete or inaccurate. Verify important information and follow product labels and qualified professional advice before adjusting chemicals, operating equipment, making repairs, or completing a transaction.
10. Reports and transactions
A verified history report reflects information available to the Services at the time it is generated. It is not a guarantee of condition, safety, code compliance, workmanship, title, future performance, or completeness. Buyers, sellers, owners, and inspectors remain responsible for their own diligence and decisions.
11. Acceptable use
You may not:
- Submit false, deceptive, defamatory, unlawful, infringing, or malicious content.
- Impersonate another person or organization, falsify credentials, or misrepresent work performed.
- Access, claim, scan, scrape, probe, or interfere with pools, accounts, records, systems, or data without authorization.
- Bypass security, rate limits, or access controls; introduce malware; or disrupt the Services.
- Use Pool Passport information to harass, surveil, discriminate against, or endanger a person.
- Copy, resell, or commercially exploit the Services except through an authorized agreement.
12. Beta features and service changes
Beta features may be unfinished, unavailable, or changed without notice and may contain errors or lose data. Back up information you cannot afford to lose. We may modify, suspend, or discontinue any part of the Services, and we do not guarantee continuous availability.
13. Fees and subscriptions
Certain features, reports, tags, or plans may require payment in the future. Prices, renewal terms, taxes, cancellation rights, and refund rules will be shown before purchase and must be finalized with counsel before paid launch. No statement that a beta feature is available creates a promise that it will remain free.
14. Intellectual property
The Services, branding, software, design, and original content provided by Know Thy Pool are owned by us or our licensors and protected by applicable law. These Terms grant only a limited, revocable, nontransferable right to use the Services for their intended purpose. Feedback may be used without restriction or compensation, subject to applicable law.
15. Third-party services
The Services may depend on or link to third-party services. We are not responsible for third-party products, content, availability, or practices. Your use of them may be governed by separate terms.
16. Suspension and termination
You may stop using the Services at any time. We may restrict or terminate access when reasonably necessary to protect users, pool records, security, legal compliance, or the Services, including for a material violation of these Terms. Sections that by their nature should survive termination will remain in effect.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” KNOW THY POOL DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR ANY RECORD, REPORT, SCORE, ALERT, RECOMMENDATION, OR CONTRIBUTION WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, OR UNINTERRUPTED. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KNOW THY POOL AND ITS AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM THE SERVICES. Any monetary cap, exclusions, and consumer-law carve-outs must be established by counsel before launch.
19. Indemnity
To the extent permitted by law, business users and users acting in a professional capacity agree to defend and indemnify Know Thy Pool from third-party claims arising from their unlawful use of the Services, their content, or their violation of another person’s rights. Counsel must determine whether and how this provision should apply to consumers.
20. Governing law and disputes
Governing-law, venue, informal-resolution, arbitration, jury-waiver, and class-action provisions have intentionally not been selected in this draft. They must be added only after counsel evaluates the operator’s entity, launch states, consumer laws, and business model.
21. Changes to these Terms
We may update these Terms. We will post the revised version with a new effective date and provide additional notice when required. Continued use after the effective date means you accept the revised Terms where permitted by law.
